Terms of Service

These Terms govern your use of Kept ("the Service"), operated by Lino Architecture Ltd ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

Kept captures and stores records about a property — including plans, documents, compliance certificates, warranties, products and finishes, and photos and video of work done to the building (including concealed work during construction or renovation) — and compiles them into a permanent Kept Record kept with the property. We may update features, pricing, and these Terms; material changes will be notified by email at least 14 days before taking effect.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. One person per account. A single property's Kept Record can be shared with additional people (for example, co-owners or a builder) by inviting them to that record from within the account that created it.

3. Acceptable use and prohibited content

You are responsible for the content you upload to Kept. You must not upload, store, or share any content that:
  • is unlawful, or infringes any intellectual property, privacy, or other rights of others;
  • is sexually explicit, pornographic, or child sexual abuse material;
  • is harmful, threatening, abusive, harassing, defamatory, or promotes violence or illegal activity;
  • contains malware, or is intended to compromise the security or integrity of the Service or others' data;
  • you do not have the right to upload or store.

Kept is intended for keeping records of your property and its contents. We reserve the right, at our discretion, to review, remove, or disable access to any content that we reasonably believe breaches these terms or the law, and to suspend or terminate accounts that do so. Where we are required by law to report certain content (including child sexual abuse material), we will do so.

You must also not: reverse engineer the Service, attempt to access other users' data, or send spam through the Service.

If you become aware of content on Kept that breaches these terms, please contact us at hello@kept.build so we can investigate and act.

4. Sensitive information

You must not upload security-sensitive access information — including alarm codes, safe locations or models, or access/lock codes. You upload content at your own risk and are responsible for what you choose to upload, and you confirm you have the right to upload it. To the maximum extent permitted by law, we are not liable for loss arising from user-uploaded content, including the consequences of unauthorised access, except to the extent caused by our negligence or required by law.

5. Your content

You retain ownership of content you upload. You grant us a limited licence to host, process, and display it solely to operate the Service. We do not sell your content.

6. Permanence

A Kept Record created through Kept is retained with the property and is not deleted if the optional Kept Membership lapses. We will not delete a Kept Record because an optional recurring membership ends.

7. Fees

One-off Kept Record fees and Kept Membership fees are billed via Paddle (our merchant of record). Prices are shown in your local currency where supported (currently USD, NZD and AUD); other regions are billed in USD. Taxes are added where required by law.

8. Cancellation

You can cancel the Kept Membership at any time from your account. Membership features continue until the end of the paid period, and your Kept Record is retained and not deleted after that. Refunds — including the 30-day guarantee on your first purchase and the 7-day window on an unused auto-renewal — are set out in the Refund Policy.

9. Termination

We may suspend or terminate accounts that breach these Terms or pose a security risk. We will give reasonable notice except where immediate action is required.

10. Warranty disclaimer

The Service is provided "as is". To the maximum extent permitted by law, we disclaim implied warranties of fitness for purpose and non-infringement.

11. Liability

Our total liability for any claim is capped at the fees you paid in the 12 months preceding the claim. We are not liable for indirect or consequential losses.

12. Governing law

New Zealand law governs these Terms. Disputes are subject to the exclusive jurisdiction of the New Zealand courts.
